JR 131 – Introduction to Science of Fiqh (3.0) Origin and development of Usul al-Fiqh, general survey of rules (ahkam), sources of Shari'ah rules (al-adilla) and methods of derivation of rules from the sources (turuq al-istinbat). This course also deals with some of the basic principles of jurisprudents such as ijma', ijtihad, qiyas, al-masalih al-mursala, istihsan, sadd al-dhara'i', local custom and the general objective of Shari'ah.
JR 135 – Everyday Fiqh (3.0) The course will cover the study of the Shari'ah regulations pertaining to a Muslim's daily life, their significance and application. Topics include: clothing (libas), drink and food (al-at'imah wa al-ashribah) and the rules of good behavior (adab) in the family, school, work place and public life in general.
JR 136 – Fiqh of Worship (3.0) This course studies fiqh of 'ibadah, related to issues concerned with salah, taharah, zakah, fasting, hajj and ‘umrah. The different methodologies of the imams of the four schools of fiqh will be studied in relation to identifying proofs, deduction and inference.
JR 231 – Science of Fiqh (3.0) The course deal with the following topics; al-Hukm al-Shari'ah (value of Shariah), al-Hukm al-Taklifi, al-Wajib, al-Mandub, al-Haram, al-Makruh and al-Mubah. Declaratory Law (Al-Hukm Al-Wad'i) Al-Shart, Al-Sabab, Al-Mani', Al-Sahih, Al-Fasid and Al-Batil. Al-Azimah wa Al-Rukhsah. Mahkum Fih, Al-Ahliyyah and Al-Hakim. Deducing the law from its sources, Al-Khass, Al-Mutlaq and Muqayyad, Al-Amr wa Al-Nahyu. Al-Am, conflicts between Am and Khas. Clear and unclear words. Investigates causes of disagreement among Muslim jurists from the time of Sahabah to the establishment of schools of Fiqh..
JR 236 – Financial Transactions (3.0) This course studies the theory of contracts in Islam, looking at their definitions, pillars and conditions. It relates theory to practice in discussion of the most important transactional contracts, i.e. sale, hire, etc.
JR 237 – Family Law I (3.0) This course gives a detailed study of family law according to the Qur’an and Sunnah and the four schools of fiqh looking at the fiqh of marriage, including the pre-marital stage, weddings, rights and responsibilities within a marriage, as well as divorce.
JR 331 – Fiqh of Muslim Minorities (3.0) This course provides an overview of the concept of fiqh of minorities and discusses important concepts with respect to this area of fiqh.
JR 335 – Contemporary Issues (3.0) An attempt to develop Fiqh solutions to questions of contemporary importance by means of methodology suited to the circumstances of modern times. Students are challenged to reconsider the classical definition of and conditions for Mujtahids and Muftis, and to consider the issues of Ijtihad and Taqlid anew. A sampling of contemporary issues will be chosen and then studied in a way that combines understanding of the issue itself and its social context with a deep appreciation of the teachings of the Qur'an and the Sunnah, as well as scholarship in the classical legal sciences of Fiqh and Usul.
JR 336 – Introduction to Islamic Finance (3.0) This course gives a more detailed study of some of the more important transactional contracts, i.e. musharakah, murabahah, ijarah, salam and istina’, also a short study of Islamic investments and financial institutions.
JR 337 – Family Law II (3.0) This course gives a detailed study of family law according to the Qur’an and Sunnah and the four schools of fiqh looking at the fiqh of inheritance and legal and illegal wills from both the Canadian and the Islamic perspective.
JR 339 – Criminal Law (3.0) A study of the rules of criminal law in Islam, covering the fixed punishments, retribution and discretionary punishments; looking also at the law of evidences and the Islamic penal system in contemporary Muslim societies.
JR 431 – Higher Objectives of Islamic Law (3.0) A study of the purpose and objective of Islamic laws that are applied by jurists in determining rulings for contemporary matters that are consistent with the principles of Islam.
JR 435 – Evolution of Islamic Law (3.0) A brief overview of the historical development of the Islamic Law and its schools (the Madh-habs). The course identifies the main reason for the appearance of the Madh-habs and the factors leading to differences among them. |
